Texas Medical Board Extends Emergency Rule for the Issuance of Certain Prescriptions

In our previous update, we discussed the Texas Medical Board’s (“TMB”) adoption of an emergency rule to help health care professionals provide necessary medical services for chronic pain patients during the COVID-19 pandemic.  The emergency rule, which allows for telephonic refills of valid prescriptions for treatment of chronic pain by a physician with an established chronic pain patient, went into effect on June 5, 2020 and was set to expire at 11:59 p.m. on July 4, 2020.  Yesterday, TMB announced that it will extend the emergency rule, which will now expire at the sooner of 11:59 p.m. on September 2, 2020 or when Texas Governor Abbott’s COVID-19 disaster declaration ends.  Except for the extension of the expiration date, the emergency rule remains unchanged.
